ร่างเกณฑ์ Stablecoin ภายใต้ GENIUS Act มีความเคลื่อนไหวอีกด้าน เมื่อ Blockchain Association ยื่นจดหมายความเห็น 26 หน้า ลงวันที่ 19 ตุลาคม 2026 ต่อร่างกฎกระทรวงการคลังสหรัฐฯ ที่ใช้มาตรา 3 ของกฎหมายดังกล่าว โดยขอให้ระบุขอบเขตผู้ถูกกำกับให้ปฏิบัติได้ชัดเจน
ข้อเสนอสำคัญคือแยกธุรกิจที่ให้บริการสินทรัพย์ดิจิทัลแก่ลูกค้าออกจากผู้ที่ซื้อขายเพื่อตนเอง รวมทั้งรักษาข้อยกเว้นสำหรับกิจกรรมบางประเภท เช่น ซอฟต์แวร์ที่ผู้ใช้ดูแลสินทรัพย์เองและการตรวจสอบธุรกรรม ไม่ให้ถูกนับเป็นผู้ให้บริการเพียงเพราะเข้าร่วมระบบ

Blockchain Association asks Treasury to clarify who falls within its stablecoin rules
Blockchain Association submitted a 26-page letter dated 19 October 2026 on Treasury’s proposed implementation of Section 3 of the GENIUS Act. It asks for clearer boundaries around the businesses covered.
The association wants customer-facing digital-asset services distinguished from proprietary trading and statutory exclusions preserved for activities such as self-custody software and transaction validation.
For foreign-issued stablecoins, it proposes reliance on regulators’ public registration and prohibition lists rather than open-ended issuer investigations. It also seeks clarity on knowing participation in unlawful issuance.
These are industry requests, not exemptions already approved by the government. Readers should distinguish the submission from final rules. Regulation does not eliminate stablecoin risk; this report offers neither an investment recommendation nor individualized legal advice.
