ASIC consults on custody and operating standards for digital-asset platforms
Crypto businesses with Australian activities have new implementation proposals to examine. ASIC issued Consultation Paper 392 on 15 October 2026, inviting feedback until 27 November on licensing guidance and operational standards for digital asset platforms, or DAPs, and tokenised custody platforms, or TCPs.
The accompanying guide describes DAPs as facilities holding digital tokens for clients, potentially alongside trading, settlement or staking. TCPs hold underlying assets and create tokens representing rights to them. Classification therefore depends on the service and rights involved, rather than simply using a crypto label.
Proposals address asset safeguarding, reconciliation and records, order handling and settlement, and operators’ financial resources. ASIC expressly warns that draft guidance and standards may change after consultation. Proposed figures and conditions should not be presented as final requirements.
CP 392 schedules DAF Act commencement for 8 April 2027 and an application or variation deadline of 7 October 2027 for existing in-scope firms. These are Australian proceedings, not automatic changes to Thai requirements. Licensing guarantees neither profit nor protection from every loss; users still face price, custody and liquidity risks.
